All institutions operating in the State must be accredited by a body recognized by the U.S. Department of Education and/or the Council for Higher Education Accreditation. New in-state institutions without accreditation are required to obtain accreditation by a body recognized by the U.S. Department of Education and/or the Council for Higher Education Accreditation within five years of authorization. For non-degree granting institutions, the institution must have the appropriate accreditation if the school offers a program in which professional qualification in a field is necessary for a graduate to obtain employment (Section 1095.40, 23 Illinois Administrative Code 1095).
Illinois Administrative Codes guiding authorization of institutions do not specify regional or national accreditation. 4: Exemptions
Under 23 Illinois Administrative Code Section 1030.10 “Institutions Required to Receive Approval,” institutions which were established and have been in continuous operation at the same location since prior to 1961 are not required to receive authorization to operate or to grant degrees at locations in the institution’s home region.
1. Institutions with Limited Physical Presence in Illinois.
2. Institutions participating in the State Authorization Reciprocity Agreement (SARA) that are determined by the Board to have limited physical presence.
3. Additional Board approval is not required for Board approved institutions offering programs:
A) On federal military bases exclusively to base personnel and their family members;
B) At clinical or practice sites that are utilized as a part of Board approved degree programs;
C) Offering dual credit courses to high school students in high schools; or
D) Offering courses inside public correctional facilities.

16: Records Retention
For degree-granting institutions (Section 1030.80 of 23 Illinois Administrative Code 1030):
1) The institution shall make students aware of how to obtain transcripts from either the closed institution and/or new institution permanently retaining the records.
For non-degree granting institutions approved by the Board (Section 1095.270 of 23 Illinois Administrative Code 1095)
1) Academic Records In the event a school proposes to discontinue its operations, the chief administrative officer of the school shall cause to be filed with the Board the original or legible true copies of all such academic records of the institution as may be specified by the Board. (Section 70 of the Act)
2) Academic records include applications for enrollment and supporting documents, enrollment agreements, transcripts and attendance records.
3) These records shall include, at a minimum, the academic records of each former student that is traditionally provided on an academic transcript, such as, but not limited to, courses taken, terms, grades, and other such information. (Section 70 of the Act)
4) In the event it appears to the Board that any such records of an institution discontinuing its operations is in danger of being lost, hidden, destroyed, or otherwise made unavailable to the Board, the Board may seize and take possession of the records, on its own motion and without order of court. (Section 70 of the Act)
5) The Board shall maintain or cause to be maintained a permanent file of records coming into its possession. (Section 70 of the Act)
6) As an alternative to the deposit of records with the Board, the institution may propose to the Board a plan for permanent retention of the records that may include the transfer of records to a similar institution. The plan must be put into effect only with the approval of the Board. (Section 70 of the Act)
